One of the saddest and ugliest parts of divorce is the fight for child custody. Children are torn between parents. They experience mental and emotional stressed. They feel confused on which parent they are to go and live with. Before we go all mushy let us first define what child custody is. Child custody refers to the package of rights as well as responsibilities that a parent holds with respect to his or her child. Child custody covers a wide spectrum of concepts. The basic essence of child custody is to find the best interest of the child and not the individual interest of the parents. In some states they follow a general rule and that is for parents to have a continuing and frequent contact with the child.

There are different types of child custody and these are as follows: a) legal custody, wherein a parent with legal custody is allowed to make certain decisions regarding the health, welfare and education of his or her child, b) physical custody, is a legal fight for the actual or physical right to be with the child, c) sole legal custody, involves the awarding of sole legal custody to one parent thus giving the sole legal parent the right to decide on the child’s health, education and welfare, d) sole physical custody, is when one parent is awarded the sole physical custody of a child meaning the child will live or remain with him or her and the other parent is not given any right from having physical custody of the child especially when the other parent has been found out to abused and neglect the child, e) join legal custody, wherein both parents are given the right to participate in decision making regarding the health, education and welfare of their child, f) joint physical custody, is where both parents have the right to be with the child and also allows both parents to conduct a parenting plan in order to settle on the schedule of taking care of their child, and the last one is g) shared custody, is wherein both the parents have equal share when it comes to the legal as well as the physical custody of the child.

As you may have notice all the different types of custody involves custody and visitation. The factors as well as the circumstances taken in consideration by the court in determining whether a parent can have custody and visitation rights are basically the same. The child visitation refers to the time given to a non-custodial parent to be with the child. On the other hand, the custodial parent’s rights to be with the child are subject to the non-custodial parent’s right to visit the child.

Together with child custody is parenting plan. This plan refers to the agreement between the parents as well as the court order in which provisions for custody and visitation rights are defined. The parenting plan also determines whether each parent or both have the capacity to make decisions with regards to the health, education and welfare of their child. The plan also includes schedules in which the non-custodial parent can spend time with the child.

Overcoming Shyness: A Way Which Really Works!

Some of the advice given out by various relationship experts does not work. Some of us have found ourselves apparently ‘failing’ to follow their advice and then wondering, ‘What am I doing wrong’. But, it is the advice which is flawed not us.

Often the advice makes a basic assumption about human nature that I believe misses the point. If the basic assumption is wrong then the advice won’t work; no matter how clever, insightful or helpful it may seem.

A lot of advice I’ve come across makes the assumption that what blocks people creating good relationships is lack confidence of some kind. While there is some truth in this, the advice goes astray after that. They assume this is down to some kind of ‘fear’, or ‘nervousness’. They assume ’shyness’ is just a form of fear. That is simply not true.

What is behind shyness is not ‘fear’; what is behind shyness is actually ’shame’. Shyness is not a fearful state; it is a ’shame’ state. Shyness is a feeling of low self-worth. Low self-worth will often masquerade as fear, anger, resentment, bitterness and so on. When that is the case than trying to tackle those issues head on (i.e. a fearful or angry attitude) does not work.

Trying to handle the ‘apparent’ issues head on can actually do damage, because we can end up ‘failing’ and our sense of self-worth sinks even lower.

Let me give you an example from the male world. This is the advice given by one notable expert (who usually gives good advice) in order to overcome ‘fear around women’. He suggests that men go to their local shopping mall and walk up to every attractive woman that they see and (after talking to her for a few minutes) ask for her phone number.

This advice will either sound appallingly simple, or simply appalling, depending on whether you are a shy guy, or not. This is supposed to help men ‘get over fear’. However, many shy guys will read this advice and know that they just cannot do it. Their low sense of self-worth will kick in, fill them with anxiety, and block them. Or, they may try it and crash and burn.

They have just been told that ‘fear’ is the root of their problem. It sure looks like fear is the problem because they feel intensely anxious even thinking about acting on the advice, never mind making any moves to try it. They then quietly assume that they are a ‘coward’, or something, for not being able to get over their supposed fear. They end up feeling really bad about themselves.

The presence of anxiety does not mean fear is the problem! The feeling of anxiety is just a ‘warning light’ that there is something deeper. It is a sign that part of us is feeling threatened and needs protection. And, maybe it is right! Maybe we ought to listen to it and find out…

Anxiety is actually a form of wisdom. Rather than trying to bludgeon our way through it, or try and ignore it, we need to work with it a bit.

One way to manage a situation we find fearful is by using our imagination to work on it before trying it for real.

Start:

+ imagine yourself in the situation

+ accept any fearful / anxious feelings which come up - without trying to make them go away.

+ notice if there are any feelings of shame, or feelings of being undeserving of what you want, or that you don’t have a right to succeed.

+ ask yourself if there are things you need to do to feel both less fearful and more deserving. (Don’t worry if you draw a blank at first).

+ imagine the possibility that you could find a good way of handling the situation. Does that help? If not, ask yourself if there is another way to achieve the results you want.

+ how will you feel when you can handle the situation the way you would like to? How will your life be different?

Take a couple of deep breaths and go back to the ‘Start’. Go around the loop a few times to see what that does to help you overcome your fear and your sense of shame / shyness.

In doing this, you may find that the process seems to go nowhere; or you may find that your fear goes away, you feel great about yourself and you know just what to do next. Most of us will experience something in between these two extremes.

In doing this you are creating a healthier relationship with yourself - no matter what the outcome. You are giving a subtle message to your inner self that you want to work with it rather than fighting with yourself. If you use it a number of times, this process will allow you to tap into your own wisdom and build your sense of self-esteem. This in turn will help you feel better about yourself and lead you to feel more confidence and far less fear or anxiety in social situations.

In this way you can overcome shame and its symptoms of fear, anxiety and lack of confidence. In this way you can overcome the real problem.

Investing vs. Trading - What’s the Difference?

There is a question which is sometimes asked by those new to the financial markets, and even occasionally debated by experienced participants. That question is how one differentiates between trading and investing. Because both trading and investing - when one considers them from the perspective of the financial markets - are performed in very similar fashions, they are often thought of as interchangeable actions.

In my book, The Essentials of Trading, I followed along with this basic theme by introducing the idea that what differentiates the two is scope definition. Both trading and investing, after all, are at the most simple of levels application of capital in the pursuit of profits. If I buy XYZ stock I expect to either see the price appreciate or earn dividends - perhaps both. What separates trading from investing, however, is that generally in trading one has an exit expectation. This might be in the form of a price target or in terms of how long the position will be held. Either way, the trade is seen to have a finite life. Investing, on the other hand, is more open-ended. An investor will buy a company’s stock with no predefined notion of when he or she will sell, if ever.

We can use examples to help demonstrate the difference. Warren Buffet is an investor. He buys companies which he sees as somehow undervalued and holds on to his positions for as long as he continues to like their prospects. He does not think in terms of a price at which he will exit the stock. George Soros is (or at least was while he was still actively running his hedge fund) a trader. His most famous trade was shorting the British Pound when he thought the currency was overvalued and ready to be withdrawn from the European Exchange Rate Mechanism. The position he took was based on a specific circumstance. Once the Pound was allowed to float freely, and quickly devalued in the market, Soros exited with a handsome profit. That meets the criteria of having a predefined exit, making it a trade, not an investment.

There is another way one can define trading as set against investing, though. It has to do with the manner in which the applied capital is expected to produce a return. In trading the appreciation of capital is the objective. You buy XZY stock at 10 expecting it to go to 15 and thereby produce a capital gain. If dividends or interest are paid out along the way, that is fine, but likely only a minor contribution to the expected profits.

In contrast, investing looks more toward income over time. That makes income production, such as dividends and bond interest payments, the major focal point. Do investors experience capital appreciation? Sure, but unlike in trading, that is not the prime motivation.

With these definitions in mind, consider what many people refer to as their single biggest investment - their home. Based our second definition of investing, however, a home is generally not an investment because in most cases is does not produce any income. In fact, it produces considerable expenses in the form of mortgage interest payments, utility bills, and upkeep. If anything, a home is a trade. We buy it and hope for its value to rise over time, increasing our equity. And the fact that many people expect to move in only a few years and sell at that point makes it even more of a trade rather than an investment. (Of course own rental property can certainly be viewed as investing, unless one is flipping it, which would definitely be more trading.)

As noted earlier, for many people trading and investing seem like the same thing. The mechanics of buying and selling are basically the same. Sometimes the analysis one does to make those decisions is identical as well. It’s the intention and definition of objectives which separate trading and investing, though.

Words You Should Never Say During Cold Calls - Ever

One of the scary things about calling on executives is that well, they are executives. They are THE decision makers, the Big Kahunas, The Top Dogs!

Executives are the leaders of the pack. Much like in the animal kingdom, they are the “Alpha dogs.” Others pups fall into line when Alpha’s growl and bare their teeth.

Respect for that Alpha’s authority automatically kicks in for many sales professionals who cold call executives. As they try to please, to be seen as worthy, and to be granted an appointment with the top decision maker.

Getting a “Top Dog” appointment is an admirable goal. A goal that quickly turns to disappointment for young pups who are rebuffed and sent down to frolic with the rest of the pack, by the “Bull Dog” (executive assistants) who guards the gate.

When the assistant says, “The executive won’t be interested in this sort of thing.” Young pups turn, put their tail between their legs and whimper as they return to whence they came.

Can young pups, newbie sales professionals avoid this kind of disappointment? You bet they can when, they learn the Top Dog Rules.

Alpha dogs are well matched when sniffing around other Alpha dogs. They know the rules, respect the boundaries, and if/when an alliance is mutually beneficial they will make that alliance.

Alpha dogs and followers are mismatched. As the Alpha dog expects the follower to follow. And the follower expects to behave as a follower.

What the heck does this have to do with sales professionals who call on executives? Plenty!

Successful sales professionals know they must speak in “Top Dog” terms to gain their respect, be seen as a leader, and be seen as another Alpha dog. This posturing is done as the sales pro talks in Alpha dog terms. They know and use the right words, the right language to gain admittance to the executives’ suites. These words earn them the privilege of romping with the Top Dogs.

These same successful sales pros never, ever use the words followers are used to using. You know, those are “permission-based” words that followers habitually use with leaders.

These savvy sales pros use the words Alpha leaders use when communicating ideas and evaluating possibilities.

Phrases such as “May I,” “Can I,” “Would you,” and “Could you” … are the beginnings of permission based, “low-level” conversations. For example:

“May I schedule on his calendar?”

“Can you tell me when to catch him in person?”

“Would you take a message?”

“Could you ask him if I may meet with him?”

The instant you utter such words the “Bull Dog”, executive assistant’s ears perk up as she recognizes you do not belong at the executive level. Reeling from how quickly the executive assistant refers the stunned sales professional to a lower level decision maker … the sales pro wonders, “What just happened?”

And thinks, “I worked up the nerve to call on the executive suites. I was well prepared when I placed the call. Then, I was transferred to the voice mail of a person way down in the organization. Calling executives is a good idea, but an impossible place to schedule a sales call.”

You can schedule executive level sales calls confidently if … you know how to speak their language.

The words on the left side of the table position you as part of the pack. The words on the right side position you as an Alpha Dog in your business arena.

Take a long hard look at the cold calling script you currently use. Replace all permission based words and phrases with words that position you as an Alpha in your industry. Remember, folks who belong at the top never ask for permission. Ever.

ERECTILE dysfunction is almost as strong a predictor of heart
disease as smoking or family history. Researchers studied 3,816
men with erectile dysfunction and 4,247 men with no dysfunction,
and they tracked the incidence of angina, heart attack,
arrhythmias, stroke and other heart problems over seven years.
Men who reported erectile dysfunction before or during the study
had a 45 per cent increased risk of a cardiovascular event
compared with men who never reported the problem.

“Erectile dysfunction is treatable,” said Dr Ian M. Thompson,
the lead author of the report and chairman of urology at the
University of Texas Health Science Centre at San Antonio, the
United States. “It may be the event that gets a man in to see a
doctor. That patient should ask his physician: ‘I used to smoke.
My dad died of a heart attack. Now I have ED. Do I need further
evaluation?’ Then the doctor has additional responsibilities to
think about cardiac illness as well.”

Dawn patrol. The morning is exploding out of the east, a half-box of crayons streaking across the sky.

Slowly, reluctantly, a bed-head emerges from the warm confines of a sleeping bag, followed by an arm, then a body. Eventually there are four or five of us milling about, sleepy-eyed, blinking away the night. One of us is munching away on Raisin Bran, the staple of his morning breakfasts, with the thousand-mile stare of a man sleep-deprived. Another is finding comfort in his coffee, and well, he should, considering he woke the surf camp staff at 6 a.m. to get it. When we find out that that only those with their own equipment can hit the water, we are disappointed, but understand the liability issues. So we are reduced to spectators, watching from the bluffs above the beach. The sunrise has reached the far horizon now, where ocean is beginning to distinguish itself from the sky. Down below, we see several lone surfers paddling into the morning gray, looking for that first set.

Such a devotion to surfing may surprise some, but those familiar with surfing understand. “Once you catch that first wave, when you stand up and you make your first turn, you get hooked,” explained Jason Senn, owner of Endless Summer Surf Camp in San Clemente, California. Sun-baked and ocean-washed, Jason has been a part of the camp since 1991, when he was brought aboard as director. According to him, the most rewarding part of his job is seeing the progression of his students throughout the week. In fact, several of his alumni surf competitively today. There is a downside, however. “Surfing can become an addiction. You start making excuses to go surfing. Missing class, missing work.” Dawn patrol was a testament to that.

By 9:30 a.m., well after Dawn Patrol had returned from its first foray, the rest of the day campers had arrived (there were roughly 12 day campers and 12 overnighters). We assembled on the beach, and although the morning fog was still hazy along the beach, it was already growing warm. A soft off-shore breeze carried the smell of salt and sun block. After a quick briefing about the basics of surfing and water safety, we were matched up with our instructors, about 3 students per staff member. After a few more detailed lessons, we hit the surf.

Three things I learned this day: 1) Surfing is tough. One aspect that is not emphasized on TV is paddling out. Getting pounded by wave after wave while your shoulder and trapezius muscles are screaming Fire! with exertion makes you very humble, very fast. There’s a reason why surfers look the way they do; 2) You can’t breath underwater, and 3) I don’t plan on quitting my day job to join the pro surf tour any time soon.

The Endless Summer Surf Camp has been teaching people, young and old, how to surf for more than ten years now. Founded in 1991 by Mary Lou Drummy, a former pro surfer and Director of the United States Surfing Federation. Drummy assembled a camp staff composed of professional surfers, including then camp director Jason Senn. In 1995, using prize money he had saved from major pro surf competitions, Jason bought the camp from Drummy. Today, Jason still actively competes on the United States Pro Surf Tour, where he has finished among the top 10 for the last three years. The Endless Summer Surf Camp is one of few camps that can boast an active pro surfer on their staff. “That’s one of the reasons I chose this camp,” one camper revealed to me. “If I was gonna fly out here from Chicago for an entire week, I wanted to make sure the staff would give me my money’s worth. That and the location.” Indeed, the Endless Summer Surf Camp can boast an ideal location. Located at the San Onofre campground, halfway between Los Angeles and San Diego, summer temperatures average 78 while water temperature averages 70. When you spend an entire day in various stages of falling into and climbing out of the water, these numbers are important.

If a professional surf director and ideal conditions are not enough to offer, the camp staff will have you packing your swim trunks and towel in no time. Hailing from various backgrounds, including two “Tico’s,” or Costa Rican locals, the staff is highly skilled, easily approachable and they seem to share an inexhaustible supply of patience and enthusiasm. I tried my best to wear them down, but in the end it was always a staff member who was pulling me off the beach, encouraging me to get back in the water and hit the surf.

As the expression goes, you learn how to ride a bike by falling off, not by lying on the beach. Or something like that. I was determined to get my day’s worth of surfing in, and I did. By the end of day one, I had swallowed hours upon hours of
